The Court found that the applicant had not filed a notice of appeal, which is a mandatory jurisdictional pre-requisite for the Court to entertain an application for extension of time to appeal. Without a notice of appeal on record, the Court lacks jurisdiction to grant the orders sought under Rule 4 of the Court of Appeal Rules. The absence of a notice of appeal cannot be cured by Article 159(2)(d) of the Constitution or by the overriding objectives in the Appellate Jurisdiction Act. Consequently, the Court declined to consider the merits of the application and dismissed it for want of jurisdiction.
