Ratio Decidendi

The court found that although the delay in filing the appeal was not explained, it was not inordinate. The court was not in a position to determine the chances of success of the intended appeal, and no evidence was presented to show that the respondent would suffer prejudice that could not be compensated by costs. The overriding objective of the court is to facilitate access to justice and ensure that deserving litigants are not shut out. Exercising its discretion, the court granted leave to appeal out of time and ordered a stay of execution on condition that the applicant deposits the decretal sum in an interest-earning account and pays thrown away costs to the respondent.
