Ratio Decidendi

The court held that the cause of action in a medical negligence claim arises when the plaintiff becomes aware of the injury and its cause, not necessarily on the date the negligent act occurred. In this case, the plaintiff only became aware that his cornea had been irreversibly damaged as a result of the surgery performed by the 1st defendant upon receiving the expert medical report from Dr. Prof. H. S. Adala on 18.07.2007. Therefore, the suit filed on 22.06.2010 was within the statutory three-year limitation period. The preliminary objection by the defendants, based on limitation, was thus rejected.
