Ratio Decidendi

The court found that the Plaintiff had established a prima facie case for the grant of an interlocutory injunction. The agreement between the Plaintiff and the 1st Defendant was duly executed and attested, with the 1st Defendant acknowledging receipt of Kshs.160,000 and a balance of Kshs.77,714. There was no evidence that the 1st Defendant demanded payment of the balance or made time of the essence before reselling the property. The 1st Defendant could not unilaterally alter the agreed balance or rescind the contract without proper notice. The Plaintiff was therefore entitled to protection by way of an injunction pending the hearing and determination of the suit.
