The court found that the Kirinyaga South District Land Dispute Tribunal acted outside its statutory jurisdiction by purporting to determine a dispute over title to registered land and ordering the subdivision and transfer of a portion of the applicant’s land. Under the Land Disputes Tribunal Act, the Tribunal’s powers were limited to boundary, occupation, and trespass disputes, not ownership or title. The subsequent adoption of the Tribunal’s award as a decree by the Senior Resident Magistrate’s Court was also ultra vires and a nullity.
