The court found that the applicant failed to demonstrate either exceptional or unusual circumstances or overwhelming chances of success in his appeal. The court held that reconciliation under section 176 of the Criminal Procedure Code does not apply to felonies, and the offence of cheating for which the applicant was convicted is a felony. The argument that the applicant would serve a substantial part of his sentence before the appeal is heard was rejected, as the appeal could be heard within two months. Consequently, the application for bail pending appeal did not meet the legal threshold and was dismissed in its entirety.
