Ratio Decidendi

The Tribunal held that it lacked jurisdiction to entertain the application for review because the applicants had already preferred an appeal and filed judicial review proceedings in the High Court regarding the same ruling. Order 45 Rule 1(a) of the Civil Procedure Rules expressly bars a review where an appeal has been preferred. The Tribunal found that, regardless of the merits of the grounds advanced for review, it could not proceed to consider them as the statutory precondition had not been satisfied. The Tribunal therefore declined to entertain the application for review and dismissed it with costs to the respondent.
