The High Court found that the trial court exceeded its jurisdiction by determining issues of trust and ownership of land within succession proceedings. The proper forum for such disputes is the Environment and Land Court as established under Article 162(2)(b) of the Constitution and Section 13 of the Environment and Land Court Act. Succession courts are only empowered to deal with undisputed testate and intestate matters and cannot adjudicate on contested land ownership or trust claims. As such, the trial court's judgment was set aside, and the appeal was dismissed for want of jurisdiction, with parties directed to seek redress in the appropriate forum.
