The High Court found that although the Penal Code prescribes a death sentence for attempted robbery with violence, the trial court exercised discretion and imposed a custodial sentence of seven years, which was considered commensurate with the offence and not excessive. The court further held that the period the appellant spent in remand custody—approximately three years—must be taken into account in accordance with section 333(2) of the Criminal Procedure Code. The sentence was therefore to be calculated from the date of first remand, March 19, 2018. The appeal was dismissed and the sentence upheld, with the clarification that the custodial term includes the remand period.
