The High Court determined that it lacked jurisdiction to entertain the application for reinstatement of the suit, as the subject matter related to land and fell within the exclusive jurisdiction of the Environment and Land Court under Article 162(2)(b) of the Constitution and Section 13 of the Environment and Land Court Act. The court noted that the suit was filed before the establishment of the ELC, but since hearing had not commenced before the High Court, the matter should have been transferred to the ELC pursuant to Section 30 of the Environment and Land Court Act and Gazette Notice No. 5178 of 2014.
