The caveat, lodged in May 2015, had served its temporary protective purpose, and the Defendant had not taken further successful steps to establish his interest. The continued maintenance of the caveat was deemed unfair and unreasonable, as it deprived the Plaintiff of her property rights without lawful justification. The law does not permit a caveat to subsist indefinitely once the underlying claim has been determined. Accordingly, the court ordered the removal of the caveat and awarded costs to the Plaintiff.
