Procedural Posture

Notice of Motion / Ruling on Application to Strike Out Defence

  1. 1 Whether the defendant's defence should be struck out for being a mere denial and disclosing no reasonable defence.
  2. 2 Whether the existence of a parallel suit challenging the auction sale precludes striking out the defence.

Ratio Decidendi

The court held that the defence raised weighty allegations regarding the lawfulness and regularity of the auction sale, which are the subject of a pending suit (Nakuru HCCC No. 343 of 2008) seeking cancellation of the sale. These issues cannot be determined summarily at this stage and require a full trial. The existence of the parallel suit and the plaintiff's own acknowledgment of it in her plaint further support the need for the defendant to be given an opportunity to ventilate his claims. Therefore, this is not a proper case for the exercise of the court's power to strike out the defence.
