Procedural Posture

Civil Suit / Ruling on Interlocutory Application for Stay of Proceedings

  1. 1 Whether the High Court should stay proceedings in Nakuru CMCC No. E248 of 2024 pending determination of the disclaimer suit.
  2. 2 Whether the insurer (plaintiff) is at risk of being compelled to satisfy a judgment in breach of the insurance policy.
  3. 3 Whether the application can be granted when the affected party (plaintiff in the subordinate court) is not a party to the present application.

Ratio Decidendi

The court declined to grant the stay of proceedings because the orders sought would directly affect a third party (the plaintiff in the subordinate court suit) who was not joined as a party to the present application and had not been given an opportunity to be heard. Granting such orders would violate the principles of natural justice. The applicant was advised to seek alternative means of prosecuting its claim, possibly by joining the affected party or pursuing other procedural avenues. The application was therefore disallowed.

Court Disposition

application dismissed
