Section 10(4) of the Insurance (Motor Vehicle Third Party Risks) Act required the insurer to file any suit seeking to avoid liability within three months of the commencement of the primary suit. The insurer filed the present suit on 25/07/2017, approximately seven months after the primary suit was filed, which is well outside the statutory period. The court held that the limitation period is a threshold issue that goes to jurisdiction, and a suit filed outside the prescribed period is incompetent and must be struck out.
