Ratio Decidendi

The court found that the Petitioner failed to prove the allegations of adultery and cruelty against the Respondent, as no evidence was adduced to support these claims. However, both parties agreed that the Respondent had deserted the matrimonial home in 2007, and the marriage had effectively broken down beyond repair. Under Section 65(c) of the Marriage Act, 2014, desertion for at least three years is a valid ground for dissolution of a Christian marriage. The court therefore allowed the petition and dissolved the marriage.
