Ratio Decidendi

The court held that the High Court lacks jurisdiction to tax an advocate-client bill of costs arising from proceedings before the Employment and Labour Relations Court (ELRC). The Deputy Registrar's acknowledgment that the matter was an ELRC matter, yet proceeding to tax the bill, was an error. Article 165(5)(b) of the Constitution expressly bars the High Court from hearing and determining disputes reserved for the ELRC. The law does not contemplate the transfer of files between courts of equal status for purposes of taxation.
