However, the appellant failed to demonstrate that the 1st respondent lacked means to refund the decretal sum, as the respondent provided evidence of employment and income, which was not controverted. The appellant's offer to deposit only Kshs 3,000,000 as security, being the insurance policy limit, was insufficient to cover the entire decretal sum. To balance the interests of both parties, the court granted a conditional stay: the appellant must pay the respondent Kshs 3,167,412 (the unsecured portion) and deposit Kshs 3,000,000 (the insurance limit) in a joint interest-earning account within 30 days,...
