Ratio Decidendi

The Court held that it has jurisdiction to hear and determine disputes relating to matrimonial property even during the subsistence of a marriage, as provided under Section 17(2)(c) of the Matrimonial Property Act, 2013. The preliminary objection, which was premised on the argument that such jurisdiction only arises after dissolution of marriage, was therefore without merit. The Court further found that the Plaintiff had established a prima facie case for the preservation of the alleged matrimonial property, given the risk of alienation or disposal by the Defendant. Accordingly, interim injunctive orders were warranted to restrain the Defendant from dealing with the properties in question...
