The court declined to grant the respondent's application for access to the children in Kenya because the children were not within the jurisdiction of the Kenyan courts, having relocated abroad. The court held that it cannot issue orders whose enforcement it cannot supervise, and that any further orders regarding access should be pursued in the courts of the country where the children are resident or domiciled. The original decree granting joint custody and access could only be enforced if the children were within the court's jurisdiction, which was not the case at the time of the application.
