Procedural Posture

Divorce Cause / Judgment

  1. 1 Whether the marriage between the petitioner and respondent has irretrievably broken down under Section 66(6) of the Marriage Act, 2014.
  2. 2 Whether there is sufficient evidence to grant a decree of divorce based on the grounds pleaded.

Ratio Decidendi

The court found that both parties alleged and demonstrated irretrievable breakdown of the marriage, with evidence of separation since 2014, lack of love and affection, and failed reconciliation efforts. The respondent had relocated to Australia, and both parties agreed that the marriage could not be salvaged. The court applied Section 66(6) of the Marriage Act, 2014, holding that the statutory grounds for dissolution were satisfied. There was no evidence of collusion or connivance. The court concluded that it would be unjust to force the parties to remain in a marriage that had become akin to servitude or bondage, and thus granted the dissolution of the marriage.
