Ratio Decidendi

The court found, based on uncontroverted medical evidence, that F M K is suffering from irreversible dementia and is incapable of managing his affairs. The applicant, as the lawful wife, demonstrated bona fides and obtained the consent of the Patient's children (except one who is also mentally challenged). The court held that the requirements of the Mental Health Act were satisfied, and that it was in the best interest of the Patient to appoint the applicant as guardian and manager of the estate.
