The court found that the applicant had not filed a memorandum of appeal or provided evidence of payment for certified copies of the judgment and proceedings, as required by Section 79G of the Civil Procedure Act. The court held that, in line with binding Court of Appeal authority, an application for leave to appeal out of time must be accompanied by a filed appeal, and that the absence of such an appeal renders the application incompetent. The invocation of Article 159(2)(d) of the Constitution could not cure the applicant's failure to comply with mandatory procedural requirements.
