The court found that the dispute did not fall within the jurisdiction of the Cooperatives Tribunal because the plaintiff was not a member of the cooperative society and the claim was not one for a debt or demand as envisaged by the Cooperative Societies Act. The plaintiff had locus standi to sue, but the issue of privity of contract between the plaintiff and the cooperative society would need to be determined at trial. The suit was not res judicata as the parties in the previous suit were not the same. The CEC Trade and Cooperative Development Nyamira County and Borabu Sub-County Cooperative Officer were not legal persons capable of being sued and were therefore struck out. The plaintiff...
