Ratio Decidendi

The court held that since the Magistrate’s Court had already delivered judgment on 12th September, 2014 and issued a decree, and there was no evidence that the judgment or decree had been set aside, there was no pending suit capable of being transferred to the Environment and Land Court. The court further reasoned that if the Magistrate’s Court lacked jurisdiction, it was incumbent upon that court to set aside its judgment to allow for a fresh suit or transfer. In the absence of such an order, the application for transfer was unmeritorious and was dismissed with costs.
