Ratio Decidendi

The court found that the Respondent failed to establish valid reasons for the Claimant's dismissal, as the system transfer in question was authorized by the warehouse manager and within the Claimant's job description. Furthermore, the Respondent did not follow due process, as the Claimant was not given a hearing or served with a dismissal letter, in contravention of Sections 41 and 43 of the Employment Act. The dismissal was therefore both substantively and procedurally unfair. The Claimant was entitled to remedies including salary in lieu of notice, accrued leave, gratuity, general damages for unfair termination, a certificate of service, and costs.
