Procedural Posture

Civil Appeal / Application to Strike Out Appeal for Procedural Non Compliance

  1. 1 Whether the omission of an annexture to an affidavit in the record of appeal constitutes a breach of Rule 85(1)(f) of the Court of Appeal Rules.
  2. 2 Whether such omission renders the appeal incompetent and liable to be struck out.

Ratio Decidendi

The Court held that the omission of the annexture to Mr. Esmail's affidavit from the record of appeal constituted a breach of the mandatory requirements of Rule 85(1)(f) of the Court of Appeal Rules. The annexture was deemed an integral part of the affidavit and the proceedings before the High Court. Since the omission was neither excused by Rule 85(3) nor curable under Rule 85(2A), the appeal was rendered incompetent. The Court therefore struck out the appeal, holding that compliance with the procedural requirements for the contents of the record of appeal is mandatory and failure to do so is fatal to the appeal.

Court Disposition

Appeal struck out for procedural incompetence.

Orders
