Ratio Decidendi

The court found that the Bill of Costs was not defective merely because it was consolidated rather than filed as separate miscellaneous causes, as the Taxing Master acted judiciously and no prejudice was shown to the applicant. On the issue of limitation, the court held that the advocate’s retainer was still in force as at 4th November, 2011, when the relevant ruling was delivered, and that the Bill of Costs filed on 7th December, 2012 was within the six-year limitation period prescribed by Section 4(1)(a) of the Limitation of Actions Act. Consequently, the applicant’s reference was dismissed for lack of merit.
