The Tribunal confirmed the existence of a loan agreement for Ksh 25,000, with a 20% monthly interest rate, but found the total claim of Ksh 70,000 to be excessive and contrary to the in duplum rule under Section 44A of the Banking Act, which limits recoverable interest to an amount not exceeding the principal.
