The Tribunal found that the Respondent was properly served and given ample opportunity to respond but failed to do so. The loan agreement was valid and the Respondent received Ksh. 20,000, but the interest and penalties claimed (Ksh. 76,000) were excessive and in violation of the in duplum rule under Section 44A of the Banking Act, which limits recoverable interest to an amount not exceeding the principal. The Tribunal held that the 20% monthly interest was only enforceable for a determinable period and could not be applied indefinitely, especially after the loan became non-performing.
