The Claimant proved the loan of Ksh 10,000 was advanced and that the Respondent defaulted. However, the Tribunal held that the 20% per month interest, without a clear time limit and resulting in a demand of Ksh 40,000, was unconscionable and contrary to the in duplum rule under Section 44A of the Banking Act. The Tribunal determined that the Claimant could only recover the principal sum and interest up to an amount equal to the principal, i.e., a total of Ksh 20,000.
