The tribunal found that while the respondent borrowed Kshs 30,000 and made partial repayments, the claimant's demand for Kshs 117,000 was based on an illegal and unconscionable interest rate of 20% per month, far exceeding the statutory maximum of 13% per annum under the Banking Act. Applying the in duplum rule and recalculating the outstanding amount at the lawful rate, the tribunal determined the correct sum due as Kshs 16,020.35 as at the date of filing. The tribunal awarded this sum to the claimant, with interest at 13% per annum from June 16, 2021, and costs, rejecting the excessive claim and refusing to enforce the illegal interest provision.
