Ratio Decidendi

The court held that it cannot transfer a suit from a subordinate court that lacks jurisdiction over the subject matter, as such a suit is a nullity in law and cannot be transferred. The applicant's own affidavit admitted that the subordinate court at Thika had no jurisdiction over the matter. In the absence of pleadings from the subordinate court, the court relied on the applicant's admission and found that there was nothing to transfer. The application for transfer was therefore dismissed with costs. The ruling was also made applicable to related miscellaneous applications as agreed by the parties.
