The respondent's assertion of an intention to appeal was unsupported by any evidence of a filed notice of appeal or application for leave to appeal out of time. The court held that it cannot act on mere speculation regarding a possible future appeal. As there was no pending appeal or legal impediment, the applicant was entitled to the orders sought, and the funds should be released to its advocates.
