Ratio Decidendi

The Tribunal found that neither party's valuation comparables were entirely satisfactory. The Tenant's comparables lacked the advantageous frontage of Moi Avenue, while some of the Landlord's comparables were not within the immediate neighborhood or had larger lettable areas. The Tribunal determined that a fair open market rent could be reached by averaging the rates from the Landlord's suitable comparables (Nos 1 and 2) and the Tenant's recommended rate. This calculation yielded a rent of KES 59,500 per month (rounded), which the Tribunal assessed as fair and reasonable for the premises. The Tribunal also ordered payment of arrears within six months and awarded costs to the Landlord.
