Ratio Decidendi

The Tribunal found that the Landlord's closure of the Tenant's business premises without issuing the prescribed notice under Cap 301 was unlawful. However, since the Tenant was in rent arrears and failed to provide evidence to dispute the Landlord's statement of account or substantiate her claim for special damages, she was not entitled to injunctive relief or compensation for alleged damaged stock. The Landlord is not entitled to rent for the period of unlawful closure but is otherwise at liberty to recover rent arrears through lawful means, including distress. Each party was ordered to bear their own costs due to the mixed findings of illegality and default.
