On substantial loss, the court noted the defendant had never been the proprietor of the suit land and questioned what loss she would suffer by being kept out of possession during the appeal. However, the court considered the element of security, noting the plaintiff's undisputed claim of loss of income from water sales amounting to Kshs. 109,500,000. The court held that, while the appeal was on an interlocutory order and not a final judgment on ownership, the appropriate security should be the amount representing the alleged loss of income, not the full value of the property....
