The High Court held that the Political Parties Disputes Tribunal (PPDT) lacked jurisdiction to entertain the dispute as the complainant failed to exhaust ODM's internal dispute resolution mechanisms, a mandatory prerequisite under Section 40(2) of the Political Parties Act. Consequently, the PPDT decision was a nullity and could not form a lawful basis for the Election Court's determination. The Election Court erred in treating the PPDT decision as final and binding, and in failing to address the substantive legal and factual issues raised in the petition, including whether the petitioners were qualified and had applied for nomination in accordance with ODM's constitution and rules....
