The court found that the orders made on 20th November, 2019 by Honourable P.J Otieno did not expressly preclude the Plaintiff from filing a Replying Affidavit. The refusal to grant an adjournment was based on the Plaintiff's failure to file the affidavit in time, not on a substantive bar against filing it at all. The court held that had the intention been to completely deny the Plaintiff the right to file a Replying Affidavit, the court would have expressly stated so. Therefore, the Replying Affidavit filed by the Plaintiff on 5th February, 2020 is properly on record.
