Any application made by the respondent's counsel without such leave is incompetent and cannot be entertained. The preliminary objection raised by the claimants was therefore meritorious, as the respondent's application to set aside judgment was fatally defective for want of compliance with the procedural requirements regarding change of advocate after judgment. The court allowed the preliminary objection, dismissed the respondent's application, and ordered that execution should proceed.
