Ratio Decidendi

The Tribunal found that the validity of the valuation report is a matter for the main trial and not for determination at the interlocutory stage. The Claimant is entitled to decide what evidence to present, and the Respondent will have an opportunity to challenge it during the hearing. The removal of the 2nd Respondent is proper as he acted only as an agent of the 1st Respondent, and no direct orders can be issued against him by the Tribunal. The amendment sought is within the contemplation of Order 8 of the Civil Procedure Rules. The application for leave to re-amend the statement of claim is therefore allowed, with no order as to costs at this stage.
