Ratio Decidendi

The High Court found that the trial magistrate erred by including invoices for interest and bank charges as part of the claim for goods sold and delivered, as these amounts were not pleaded or supported by an agreement or custom. The court held that only the principal sum for goods actually delivered and unpaid was recoverable. The sum of Kshs. 432,795.50, representing interest, was excluded from the judgment, reducing the amount due to the respondent to Kshs. 819,410.50. The court set aside the subordinate court's judgment and substituted it with judgment for the respondent for the reduced amount, with interest at court rates from 31st March 1997.
