The High Court determined that although the subordinate court is ordinarily the court of first instance for applications for stay of execution or proceedings, Order 42 Rule 6(6) of the Civil Procedure Rules vests the High Court with jurisdiction to grant such orders provided the appeal has been properly instituted. The court found that the application was made without unreasonable delay and that, while the applicants' apprehension of loss was not sufficient on its own, the potential for the appeal to be rendered nugatory if the respondent proceeded to distribute the estate justified the grant of stay.
