Ratio Decidendi

The court found that the respondent's appeal was filed against an order made under section 3A of the Civil Procedure Act, which is not among the categories of orders for which an appeal lies as of right under Order XLII of the Civil Procedure Rules. Therefore, leave of the court was required prior to filing the appeal. Since the respondent did not seek or obtain such leave, the appeal was incompetent and could not be allowed to remain on the record. Consequently, any orders of stay obtained pending the appeal were rendered ineffective and were discharged. The application to strike out the appeal was meritorious and was granted with costs to the applicant.
