The court found that the applicant had not sufficiently demonstrated that she would suffer substantial loss if stay was not granted, as mere financial hardship or the size of the sum is not enough. However, the application was filed promptly, and the applicant offered security by proposing to deposit the principal sum. The respondent, being a large company, could refund the decretal sum if the appeal succeeded. Balancing the interests of both parties and in the interest of justice, the court exercised its discretion to grant a conditional stay of execution, requiring the applicant to pay half the decretal sum within 20 days as a condition for the stay, with each party bearing its own costs.
