The Tenant failed to notify the Landlord of non-compliance and did not refer the matter to the Tribunal within the statutory period, instead filing the application three months after receipt of the notice. The Tribunal also determined, based on business permits and licenses, that the premises qualified as a business premise under Cap 301, thus affirming its jurisdiction.
