The court held that Magistrates' Courts have never had jurisdiction to determine claims for adverse possession, as such jurisdiction is expressly reserved for the High Court (now the Environment and Land Court) under Section 38 of the Limitation of Actions Act. The misconception that magistrates could hear such claims did not alter the law, and divergent judicial opinions did not confer jurisdiction. Since the suit was filed in a court lacking jurisdiction, the Environment and Land Court cannot transfer it to itself or any other court.
