However, the application to transfer and consolidate was rendered moot because the Small Claims Court matter (SCCCOMM No. E5576 of 2023) had already been concluded and was at the appeal stage. As such, consolidation was no longer possible, and the application had been overtaken by events. The applicant was advised to pursue its claim in the Chief Magistrate's Court, and each party was ordered to bear its own costs.
