The court found that the petitioner had established the ground of cruelty based on unchallenged evidence of physical abuse, neglect, and mistreatment by the respondent. The grounds of desertion and adultery were not proved to the required standard: desertion had not lasted the statutory three years, and adultery was not sufficiently substantiated. There was no evidence of collusion or condonation. The marriage was found to have irretrievably broken down, justifying dissolution on the ground of cruelty.
