The High Court, by virtue of section 7 of the Appellate Jurisdiction Act, has jurisdiction to extend time for filing a notice of appeal even in succession matters. The court further held that, in succession causes, leave to appeal is not automatic and is only granted where there are prima facie grounds meriting serious judicial consideration. In this case, although the applicants' prospects of success may be doubtful and their claims of trust or beneficial ownership may be more appropriately determined in the Environment and Land Court, the court found that the threshold for leave was met.
