However, since the marriage has not been dissolved, division of the property cannot be determined at this stage. The Plaintiff failed to prove her case for a permanent injunction, as the Defendant remains the registered proprietor and there was no evidence of trust or exclusive entitlement. The Plaintiff has a beneficial interest due to her contribution, but not an exclusive right. The Defendant, having proved his case for subdivision in the counterclaim, is entitled to have the land subdivided equally between the two families....
